Any invention that is novel, involves an inventive step (non-obvious), and is capable of industrial application can be patented — including products, processes, methods, and compositions of matter. Pure software, business methods, mathematical methods, and discoveries of natural phenomena are not patentable under the Patents Act.
A provisional application locks your priority date immediately — which matters because patent rights go to the first to file. Once filed, you can safely disclose the invention to investors or at conferences, and you have 12 months to refine and file the complete specification at a lower cost than jumping straight to complete.
The Indian Patent Office typically takes 2–5 years from complete specification filing to grant. However, requesting early publication and expedited examination (available to startups and others) can significantly reduce this timeline.
