Trademark questions answered honestly
The process takes 18–24 months from filing to registration certificate in straightforward cases. If an examination objection is raised, it may extend to 2–3 years. However, you can use ™ legally from the day your application number is issued — which happens the same day as filing.
™ (TM symbol) means your trademark application has been filed but is pending. You can use it legally from the day of application. ® (Registered symbol) can only be used after IP India issues the Registration Certificate. Using ® before registration is a legal offence under the Trade Marks Act.
After publication in the Trademark Journal, anyone can file an opposition within 4 months. If opposed, a hearing before the Trademark Registry takes place.
